Terms of Use for QuizzMe

These Terms of Use ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and QuizzMe (“we,” “us,” or “our”), concerning your access to and use of the QuizzMe website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Platform”).

You agree that by accessing the Platform, you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Platform and you must discontinue use immediately.

1. Eligibility

You must be at least 13 years of age to use the Platform. By agreeing to these Terms, you represent and warrant to us that you are at least 13 years of age. If you are under the age of 18, you must have your parent or legal guardian's permission to use the Platform and to agree to our Terms.

2. User Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Platform. You are responsible for safeguarding the password that you use to access the Platform and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. User-Generated Content

Our Platform allows you to create, upload, post, send, receive, and store content, including quizzes, questions, text, and images ("User Content").

Responsibility for User Content: You are solely responsible for your User Content. You assume all risks associated with use of your User Content, including any reliance on its accuracy, completeness or usefulness by others, or any disclosure of your User Content that personally identifies you.
License Grant to QuizzMe: You retain all of your ownership rights in your User Content. However, by submitting User Content to the Platform, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Platform and our business, including for promoting and redistributing part or all of the Platform.
Content Moderation: We reserve the right (but have no obligation) to review any User Content, and to investigate and/or take appropriate action against you in our sole discretion if you violate the Acceptable Use Policy or any other provision of these Terms.

4. Acceptable Use Policy

You agree not to use the Platform to collect, upload, transmit, display, or distribute any User Content (i) that violates any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; (ii) that is unlawful, harassing, abusive, tortious, threatening, harmful, invasive of another’s privacy, vulgar, defamatory, false, intentionally misleading, trade libelous, pornographic, obscene, patently offensive, promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual or is otherwise objectionable; (iii) that is harmful to minors in any way; or (iv) that is in violation of any law, regulation, or obligations or restrictions imposed by any third party.

5. Intellectual Property Rights

With the exception of your User Content, the Platform and all of its content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by QuizzMe, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Platform will immediately cease. If you wish to terminate your account, you may do so from your account settings page.

7. Disclaimers

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the Platform. We do not warrant that the Platform will be uninterrupted, secure, or error-free.

8. Limitation of Liability

To the fullest extent permitted by law, in no event will QuizzMe, its affiliates, officers, employees, agents, suppliers or licensors be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Platform; (ii) any conduct or content of any third party on the Platform; (iii) any content obtained from the Platform; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

9. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of India. We agree to first attempt to resolve any disputes informally. For any dispute, you agree to first contact us at [email protected] and attempt to resolve the dispute with us informally.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. You are advised to review these Terms periodically for any changes. Changes to these Terms are effective when they are posted on this page.
